Do I really need a registered will?
A will does NOT need registration under Indian Succession Act 1925 — Section 18 lists it as optional. What's mandatory: handwritten or typed text, your signature, two witness signatures (witnesses cannot be beneficiaries). Registered wills are slightly easier to prove in probate but most family wills stay unregistered for privacy.
Gift deed vs inheritance — what's the difference for tax?
Gift deed transfers ownership during your lifetime. Gifts to immediate family (spouse, children, siblings, parents) are EXEMPT from income tax under Section 56(2)(x). Gifts to non-relatives above ₹50K are TAXABLE in the recipient's hands. Inheritance (via will after death) is currently NOT taxed in India. Consult your CA before transferring high-value assets.
Can I name minor children as beneficiaries?
Yes — but the will must name a guardian who holds the assets in trust until the minor reaches majority (18). The gift deed similarly requires natural-guardian acceptance for minor recipients. The generator prompts you for guardian details when minors are listed.
What if a family member contests the will?
Wills can be contested on grounds of undue influence, lack of mental capacity, forgery, or coercion.
